Acceptance of terms

By accessing this website or requesting our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using our services on behalf of a company, you confirm you have authority to bind that company.

Our services

DataPeak provides drone-based aerial mapping, photogrammetry, inspections, 3D modeling, volumetric measurements, and aerial photography and videography. The specific scope, deliverables, and timeline for your project are defined in your written quote, which forms part of these Terms once accepted.

Quotes & payment

• Quotes are provided in writing and are valid for 30 days unless stated otherwise.
• Each quote describes a fixed scope. Work outside that scope is quoted separately before we proceed.
• Payment terms are stated on your quote or invoice. Late balances may pause work or delivery.

Scheduling & weather

Aerial capture depends on safe, flyable conditions. We schedule flights with reasonable flexibility and monitor the forecast. If weather, airspace, or site conditions require us to reschedule, we will notify you promptly and agree on a new window. Delivery dates shift with rescheduled flights, not your agreed price.

Site access & safety

You are responsible for arranging lawful access to the site and informing us of hazards, restrictions, or other parties on site. We operate safely and may pause or cancel a flight if conditions are unsafe or non-compliant. Repeated lost trips caused by access issues may incur additional charges.

FAA compliance

All flights are conducted by FAA Part 107 certified remote pilots in accordance with applicable regulations. Where a flight requires airspace authorization or a waiver, we obtain it before flying. You agree not to ask us to operate outside what regulations allow.

Deliverables & accuracy

We deliver in the formats agreed in your quote. Stated accuracy figures assume suitable site conditions, and are documented so your team can verify them. Accuracy can be affected by vegetation, terrain, weather, and other factors outside our control.

Not a licensed survey

DataPeak is a drone data provider, not a licensed surveying firm. Our deliverables are high-accuracy and decision-grade, but they are not a legal substitute for a boundary or land survey performed by a licensed surveyor. For work that legally requires a licensed surveyor, we recommend engaging one. Our control-verified data can support their work.

Intellectual property

On full payment, you receive the rights to the deliverables specified in your quote for your intended use. We retain ownership of our methods, software, and templates, and may retain copies of work for our records and portfolio unless you request otherwise in writing. Website content and branding remain the property of DataPeak Solutions.

Liability

To the fullest extent permitted by law, our total liability for any claim arising from a project is limited to the amount paid for that project. We are not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited by law.

Governing law

These Terms are governed by the laws of the State of Colorado. Any dispute will be handled in the courts located in or serving La Plata County, Colorado.
